Family Dispute Resolution (FDR)
Structured process to resolve family disputes before court proceedings
What is Family Dispute Resolution?
Family Dispute Resolution (FDR) is a process where parties work with an accredited family dispute resolution practitioner to resolve parenting and/or property disputes. In Australia, in most cases, you are required to make a genuine effort at FDR before filing court applications for parenting orders.
FDR provides a structured yet flexible framework for families to communicate effectively, understand each other's perspectives, and work toward mutually beneficial solutions that prioritise children's best interests.
What FDR Can Help With
Parenting arrangements and schedules
Living arrangements for children
Communication and decision-making
Holiday and special occasion arrangements
Property and financial matters
Post-separation parenting issues
The Family Dispute Resolution (FDR) Process
Step 1: Initial Contact
Begin by reaching out to the other party to invite them to participate in FDR or mediation. If both parties agree to proceed, you can book a half-day or full-day mediation through our bookings page.
Step 2: Requesting an FDR Invitation
If you have not received a response—or would prefer us to initiate contact—you can request a formal FDR invitation via our online form. A fee applies for this service.
Step 3: Sending the Invitation
We will send an invitation to the other party outlining the FDR/Mediation process, our services, and associated costs. They will be asked to respond within seven days. We will keep you informed of any updates and let you know when a mediation can be scheduled.
Step 4: Issuing Documentation
If there is no response after a follow-up, and mediation cannot proceed, we may issue a s.60I Certificate confirming that FDR was attempted or deemed inappropriate.
Why Choose FDR?
Family Dispute Resolution offers families the opportunity to resolve disputes in a supportive, structured environment that focuses on children's wellbeing and practical solutions. It is designed to be less adversarial than court, helping preserve important family relationships while addressing the issues that matter most.
Most importantly, FDR puts you in control of the decisions affecting your family, rather than having a judge make those decisions for you.
